Structural engineers who participate in any investigation or root cause analysis following an accident or incident will inevitably be asked to provide communications and opinions. These communications often have crucial –if not dispositive–consequences in future litigation, liability assessments, insurance coverage analysis, and public relations matters. During our seminar, we will examine the applicable and potentially applicable ethical duties and legal privileges that should guide best practices for an engineer's communications. We will examine cases where such communications have been scrutinized and provide takeaways/best practices from same.
About Our Speaker:
Nipun J. Patel is a partner and trial lawyer in Holland & Knight's Philadelphia office who maintains a national practice focused on complex litigation matters. Mr. Patel represents businesses across a variety of industry sectors in commercial contract, business tort, data privacy, financial services, employment, restrictive covenant and putative class action litigation. Mr. Patel's experience as a first-chair trial lawyer includes representation of plaintiffs and defendants in state and federal courts, as well as in arbitration proceedings before the American Arbitration Association (AAA), Financial Industry Regulatory Authority (FINRA) and Judicial Arbitration and Mediation Services (JAMS). Mr. Patel has also led and argued numerous appeals in state and federal court. Nipun received his undergraduate and law degrees from Temple University, with honors.
